Terms and conditions

All information supplied by this web site is given in good faith and should only be used as a guide. All information must be confirmed, errors and omissions accepted.

Delivery & Returns
During these difficult times we are doing our very best to fulfil your online orders. If your item is in stock, we will dispatch your order as normal but regrettably cannot guarantee a next day service. We are working with our delivery partners to provide the fastest delivery possible.

If any part of your order is out of stock, we will contact you by email – please check your spam/junk filters. If your order is an essential item, please call one of our team on 01367 643574 during weekday office hours, to check stock prior to your order.

The Dean Forge delivery service…Dispatch Times
At Dean Forge Ltd we appreciate just how important it is to receive your stove and accessories promptly. That’s why if you place your stove and accessories order with us before noon on a weekday and the order is in stock, then we will endeavour to dispatch within 1-3 working days. Exceptions are Bank / Public Holidays, Weekends and during exceptionally busy periods (Autumn / Winter). In these instances, the parcel will leave within 1-5 working days.

Delivery of Dean Stoves/Pallet items.
Delivery charges will be priced individually depending on location.  We will confirm any charges before an order is taken.  For orders of Dean stoves, we have a list of UK stockists that supply Dean Stoves to the public, you can locate your nearest stockist by going to the stockist locator and entering your post code.

Please read carefully
All pallet deliveries are made by lorries with tail lifts and pallet trucks. The pallet will be delivered to the kerb side only. You (the customer) must make arrangements to meet the lorry either at the delivery address or at a convenient point where the lorry can access, unload and turn if needed. You must then make your own arrangements to move the goods from that location (kerb side or meeting point).

Returns
Any returns to us via Carrier must be paid by you the customer.  Please check that there is no damage to the goods and sign the delivery note. If you find damage do not accept the goods or sign and write damaged on the delivery note.  If damage is caused by the transportation of the goods, and the goods are signed for as received in good condition (or words to that effect), by signing the delivery note you have accepted the goods as undamaged. You will not be able to claim for replacement or repairs.

Payment
We accept payment by most debit cards, credit cards, cheque or bank transfer. A non-refundable deposit would be taken for any item we have to order in and the remainder paid before dispatch. Parcel Delivery
All mainland UK parcels (excluding Scottish Highlands & specific postcodes) leave here within 1 – 3 working days effected by the courier.  We do not offer a next day delivery as it is not a guaranteed service.  Once the parcel leaves here, your goods are in the hands of the courier. Exceptions to our standard Delivery are Bank / Public Holidays, Weekends and external circumstances beyond our control such as breakdowns, extreme weather etc. If you require a weekend delivery, please contact us for a quotation. Where an email address has been provided, the courier will normally send an Email message the morning of delivery with an estimated time slot for delivery. All consignments can be tracked if the customer visits www.apc-overnight.com.  Customers email address is usually placed into the delivery when booking this will alert the customer with a 2 hour delivery window, however during the pandemic this has been taken down as timed slots have not been guaranteed due to the volume of freight travelling through the network at the moment.

There is also an opportunity at the checkout to add a note for the delivery driver.

Pallet Transport
Where items are not suitable to go via a parcel delivery service, the goods will be sent via a standard Pallet Transport. We use a ‘booked-in’ service and the courier will confirm your delivery day and times.  We reserve the right to use a tracked/recorded service, which may require a signature. If you do not wish to sign for a parcel, you must state this on the order. In doing so you accept liability for delivery. Standard delivery times apply.  We cannot accommodate special delivery requests for orders sent via standard pallet transport.

What happens if my order is out of stock?
Due to the high turnover of stock, we are unable to display live stock levels. Therefore, If your order is urgent, please check stock availability prior to ordering by calling us on 01364 643574. Orders that are not in stock will be notified by email. We endeavour to keep any waiting times to a minimum, but any delay will vary according to product demand and time of year. In some instances, this can take up to 28 days or in very rare cases longer. Delays occurring with suppliers/importers are beyond our control. Rest assured, once the stock arrives the turn around here is very quick. If you haven’t heard from us check your spam/junk folder.

Charges
Shipping and handling charges are based on order weight and delivery destination. These charges cover the handling and processing of the order/payment, packing materials, and the cost of delivery. This charge will be shown at the checkout before any payment details are required.

Timescale & Destinations
At Dean Forge Ltd we are pleased to offer our customers spare parts available from stock and products to order from our wide range of suppliers.  If your order is in stock, we aim to despatch within 1 – 3 working days (excluding weekends and public holidays) or same day if ordered before noon. In the event one or more parts have to be ordered in for you, you will be notified by email. We endeavour to keep any waiting times to a minimum, but any delay will vary according to manufacturer and time of year. In some instances, this can take up to 28 days. Once the order is complete, you will be notified by email, and the goods dispatched in full. We do not ship part orders. Below is a list of the current destinations we are able to ship to. Upon receipt of your despatch confirmation email, please allow the following delivery times.

To avoid delays, please ensure your address details are accurate and the shipping destination correctly selected. Orders with an incorrect shipping destination, entered to obtain cheaper shipping rates, will not be dispatched until further payment is made. We regret that we cannot deliver to PO boxes or Boats. Other destinations – Price on application.

Options & Instructions
During the checkout process, we can offer different delivery options to suit your requirements. There is an option for a separate delivery address to that of the billing address.

For orders sent via courier only, we are able to offer a service whereby notes can be made for the driver. E.g. Parcel can be left in the garden shed. Where specific notes are made for the courier, this is done so entirely at the customer’s risk. We cannot accept liability for any loss arising as a result of this, however, caused. Finally, we are not currently able to accommodate specific dates or times for delivery, however, if a mobile number is supplied, the courier will normally send an estimated delivery time via email. A tracking number can also be provided upon request.

Cancellation & Returns Policy

The Consumer Contracts Regulations 2013 legislation offers you the following cancellation rights when you buy online or by phone:

You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.

Your right to return or cancel products does not apply to goods that are made to measure or are made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly. This doesn’t affect your statutory rights if goods are faulty or not as described.

If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.

To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.

You can cancel by email, or write to us.

If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This includes the cost of delivery (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).

We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

Damages / Shortages
Please check your delivery carefully upon receipt. In the unlikely event of any damages or shortages, you must notify us within 24 hours for a delivery via pallet transport or 3 working days via parcel delivery service. Regrettably claims made after this period will not be accepted. We will request images of the damaged goods (sent via email) for insurance purposes. Only once we have received and assessed the images a decision will be made as to how we will procced. If the damage is clearly done while in transit we then send out replacement goods. Finally, we would request that you retain the damaged items for 21 days, as in some cases we may wish to collect them.

These Terms of Business apply to Retail Purchases and Website Users.

What you can expect from us;
We care for our customers because you are our business. Customer satisfaction is paramount, excellent service is our aim. We recommend a visit to our showroom for a positive, informative and enjoyable experience, where we can help you to choose the right products and/or services for the right reasons.

If you are ordering a Speciality Product, or if you are taking advantage of our Installation Service, you will receive additional terms of business relating to those specific elements, but these Terms will also continue to apply.

By making a Retail Purchase, placing an order and/or accessing our Website(s) you agree to be bound by these Terms (including any Speciality Product and/or Installation Service terms of business) and any orders placed by you are strictly in accordance with these Terms.

Definitions
Personal Information– means the details provided by you
Product– means a product or service offered for sale by us
Product Description– means details of individual Product(s) where provided

Website Users– means the users of the Website collectively

Personal Information

You warrant that:
The Personal Information which you provide to us is true, accurate, current and complete in all respects; and
you will notify us immediately of any changes to the Personal Information by contacting us.

Description of products
Each Product purchased is sold subject to its Product Description including, without limitation, estimated delivery dates and times, warranties, after-sales service and guarantees.

We take all reasonable care to ensure that all details, descriptions and prices of Products are correct. Although we aim to keep these as up to date as possible, if you wish to rely upon specific details please confirm them with us in advance. We cannot confirm the price of a Product until your order is accepted.

We may provide brochures, information sheets, links to and/or details of third-party resources for you to use at your sole discretion. You acknowledge and agree that we are not responsible or liable, directly or indirectly, for the privacy practices, advertising, content, products, goods or other materials or services of those third parties.

Warranties
We always support the manufacturer’s warranty period where offered. As an official reseller appointed directly by the manufacturer this warranty and the length and terms of these warranties will frequently exceed warranties available from other outlets.

Consumables items such as, but not limited to, Glass, Firebricks, Baffles, Grates, seals are not covered under a warranty. A full description of all consumables are listed in the Stove Operating document. This is because they are a consumable item. Consumable items have a limited lifespan which will depend on the operation and correct installation of the product. As there is no control over these factors a warranty is not offered.

Manufacturer’s Warranties vary by product, whether they are new or ex-display, and sometimes by date and method of installation, and may be for parts only, non-transferrable and restricted in other ways such as accidental or cosmetic damage, failure to follow manufacturer’s instructions or installation guidelines, lack of cleaning or servicing, deliberate damage or neglect. If you wish to confirm manufacturer warranty details prior to purchase please contact us.

During the warranty period, if your product develops a fault that needs to be repaired, look for visible signs of the breakdown and consult the fault-finding guide in the manufacturer’s handbook, if any.

If that doesn’t resolve the issue, please contact us, when we’ll liaise with the manufacturer and/or installer on your behalf. We’ll always do our best to make sure you’re satisfied with the outcome.

Delivery
If delivery is required, we will discuss convenient delivery arrangements with you and will ask you to provide relevant Personal Information to enable us to assess the delivery requirements.

Delivery of the Goods shall take place at the delivery address specified on the order or as subsequently agreed between us. If no address is specified, or in the event that we incur any failed delivery cost or expenses due to inadequate access or incorrect site information provided, delivery will be at our place of business.

You will take delivery of the Goods within two weeks of us giving you notice that the Goods are ready for delivery unless arrangements are made between us for longer storage.

Times for delivery are given as accurately as possible but cannot be guaranteed. You shall have no right to damages or right to cancel the order for failure to meet any delivery time stated.

We will endeavour to comply with your reasonable requests for postponement of delivery but shall be under no obligation to do so.

If you fail to accept delivery (for whatever reason) or if we have agreed to a postponement, or if we are unable to deliver the Goods on time because you have not provided appropriate equipment, personnel, instructions, documents, licences or authorisations we may store the Goods until delivery, whereupon you shall be liable for all related costs and expenses (including, without limitation, storage and insurance).

You shall have no right or claim for shortage or defects or mis-delivery unless you have inspected the Goods immediately on delivery and send us a written notification within (24 hours – Pallet delivery Transport) 3 working days (Parcel Delivery) of the delivery specifying the shortage or defect and to the carrier within three days of delivery or such longer period as the carrier’s conditions permit, and we are given a prompt opportunity to inspect the Goods in their original condition. If you do not make a notification to us or to the Carrier, the Goods shall be deemed to have been delivered in the correct quantity and free of defects apparent on inspection. – Double check this statement

Cancellation
Cancellation will only be accepted by us in writing and on condition that all costs and expenses incurred by us up to the time of cancellation, and all loss of profits and other loss or damage resulting to us because of the cancellation will be reimbursed to us by you forthwith.

We may suspend or cancel any order or part of an order if delivery is by instalments, by written notice if you fail to pay us any money when due (under the order or otherwise) or you fail to honour your obligations under these Terms.

Limitation of liability
Where we act as suppliers of the Goods of those we do not manufacture, and for those goods our liability is limited as such. This does not affect your statutory rights as a consumer.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Terms for:

any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Terms.

Nothing in the Terms shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

 Severance, Waiver & Survival
If any part of the Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and shall not affect the validity and enforceability of any of the remaining provisions of the Terms. No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision. Each provision of the Terms shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement
These Terms govern our relationship with you. Any changes must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what we expect of each other. You confirm that, in agreeing to accept the Terms, you have not relied on any representation save insofar as the same has expressly been made a term of these Terms and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these Terms. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Terms.

Law
The Terms shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

Neither Dean Forge Ltd or their employees can accept any liability for errors or omission on the web site. Every effort is made to give true and accurate information but errors and omissions are possible.

The Dean Forge web site is only intended as a product identification site, please confirm specifications of wood burning stoves and multifuel stoves and other appliances before placing an order.

All prices on this web site include V.A.T. at current rate.
